Bill 21 makes changes to provincial and municipal responsibilities during an emergency event
Bill 21, The Emergency Statutes Amendment Act has received third reading in the Alberta legislature. The RMA provided an initial analysis of Bill 21 following its introduction, and an in-depth analysis is now available for members and other interested stakeholders. The analysis provides an overview of how Bill 21 amends six pieces of legislation, and includes a discussion of the RMA’s concerns regarding:
- Provincial control of a state of local emergency
- Who is responsible for communications and announcing public-facing decisions
- How when the province intervenes, municipalities remain responsible for paying the costs
- How “public interest” will be defined
- Municipal liability when the province intervenes
The RMA will continue to monitor the implementation of Bill 21, including identifying potential opportunities to provide input on the development of any regulations.
