On Thursday, October 26th, the Minister of Municipal Affairs, Shaye Anderson, through an Order in Council, proclaimed the majority of the amendments to the Municipal Government Act that were introduced through An Act to Strengthen Municipal Government and the Modernized Municipal Government Act. Accompanying these acts are several associated regulations which contain far greater details to the contents of the legislative amendments. The regulations which are now in force can be found here.
There are, however, several sections related to the MGA that are not in force. They include:
- Sections related to inclusionary housing
- Sections related to offsite levies on provincial infrastructure
- Sections related municipally controlled corporations
- Sections related to the Community Organization Property Tax Exemption regulation (COPTER)
These four areas require additional policy development and consultation.
Resources to assist municipalities in transitioning to the new MGA are available here or see the related member bulletin in this week’s version of Contact.
