Energy Lease Payment Tools for Landowners

AER and Farmers Advocate have tools available to landowners if oil and gas companies do not fulfill their access agreements

Many rural Alberta landowners have benefited economically from surface access agreements with oil and gas companies. However, there are situations where individual energy companies have approached landowners in an attempt to not pay the full amount agreed to in their surface access agreement. Landowners can register their private surface agreement (PSA) with the Alberta Energy Regulator (AER). Once a PSA is registered with the AER, the AER can help enforce the terms of the PSA, including non-payment for surface access.

An additional resource for Alberta farmers is the Farmers Advocate Office (FAO). A recent FAO release notes that some farmers are being approached by oil and gas companies with infrastructure on their land offering a reduced access payment. Farmers with concerns about this activity are encouraged to contact FAO by phone at 310-FARM (3276) or farmers.advocate@gov.ab.ca.
