In Spring 2023, the RMA contracted Brownlee LLP
to develop a technical report
on select quasi-judicial agencies in Alberta, with a focus on how and to what extent municipalities are involved in their processes. The Brownlee report is intended to accompany the findings of the RMA Member Committee
on Quasi-judicial Agencies (QJAC). The reports were completed separately and provide different perspectives on the same issue.
The report analyzes three agencies: the Alberta Energy Regulator, the Alberta Utilities Commission, and the Natural Resource Conservation Board. The report focuses on how each agency defines and represents the public interest and considers municipal plans and perspectives. The report includes several recommendations on how the agencies could improve their approval processes to better include municipal perspectives.
