Brownlee LLP Technical Report on Quasi-Judicial Agencies Now Available

Brownlee LLP developed the report for the RMA to provide a technical perspective on the municipal involvement in AER, AUC and NRCB processes

In Spring 2023, the RMA contracted Brownlee LLP to develop a technical report on select quasi-judicial agencies in Alberta, with a focus on how and to what extent municipalities are involved in their processes. The Brownlee report is intended to accompany the findings of the RMA Member Committee on Quasi-judicial Agencies (QJAC). The reports were completed separately and provide different perspectives on the same issue.

The report analyzes three agencies: the Alberta Energy Regulator, the Alberta Utilities Commission, and the Natural Resource Conservation Board. The report focuses on how each agency defines and represents the public interest and considers municipal plans and perspectives. The report includes several recommendations on how the agencies could improve their approval processes to better include municipal perspectives.

Brownlee LLP recently hosted a workshop at the RMA 2023 Fall Convention, and the report was recently published. For more information, please refer to the full report.
